The following Terms & Conditions apply to The Brass Room studios. As a Student, you acknowledge that you have read and understood the following Terms and Conditions and agree to be bound by them. We may sometimes add, change or remove our Terms and Conditions. The most up to date Terms and Conditions will always apply, which you can find here on our website.

We will give you 14 days notice of any changes to any Terms and Conditions by publishing them on our website and emailing you. 

Memberships

We offer the following types of memberships: 

1 CLASS PER WEEK $27.50 per week (Cost per class $27.50)

2 CLASSES A WEEK $50 per week (Cost per class $25) 

3 CLASSES A WEEK $67.50 per week (Cost per class $22.50)

4 CLASSES A WEEK $80 per week (Cost per class $20)

5 CLASSES A WEEK $100 per week (Cost per class $20) 

6 CLASSES A WEEK $120 per week (Cost per class $20)

Membership Agreement

By signing your Membership Agreement, you agree to be bound by the terms and conditions of the Direct Debit Service Agreement. You must ensure that you are aware of and understand these terms and conditions. 

Commencement Date

Your membership commences on the date specified as the Commencement Date on your Membership Agreement. 

Membership Minimum

You are committed to your membership for 8 weeks (8 weekly payments) from the Commencement date. 

Payment

Your first payment is payable on the day you sign your Membership Agreement. This first payment is not refundable, even if you cancel your membership within the cooling off period. We will debit your membership fees from your nominated financial institution weekly, as set out in your Membership Agreement.

Cooling Off Period

You have 48 hours from the date of your Membership Agreement to cancel your membership by writing to us. 

Membership Changes

You can downgrade your membership, after the initial minimum term of your Membership Agreement, by giving us 14 days’ notice in writing prior to the new term commencing. Once the term has commenced, you cannot downgrade your membership. 

You can upgrade your membership at any time by contacting your studio. The initial minimum term of 8 weeks will recommence from the new Commencement Date. 

Catch Up Classes

A minimum of 24 hours’ notice is required to cancel a class. If you give more than 24 hours notice, you will be entitled to a catch up class that you can use to book another class at another time, subject to availability and pre-requisite. You will have until the end of that term to catch up those classes, after which they will expire. Classes will not be transferred over to the following term. 

Payment Arrears

If your fees are in arrears for more than 14 days, we will cancel your membership until your payments are up to date. We reserve the right to cancel all your booked classes. We will continue to debit your nominated account without notice until we have recovered the total amount outstanding. If you continue to attend classes without an active membership you will be charged the $35 casual rate from your nominated account.

Membership Suspension

During the Christmas/New Year closure your direct debit payments will automatically suspend whilst the studio is closed over this break.

You can freeze your membership for a maximum of 8 weeks each calendar year by giving the studio 14 days’ notice in writing. The minimum suspension period is 2 weeks. We will not backdate your request to freeze your membership. 

If you are within your minimum term, you can freeze your membership but you will still be required to pay the full amount of your minimum term when your suspension ends.

If you have an injury or illness and provide a doctor or physiotherapist’s note, we can waive the requirement for 14 days’ written notice. Suspension would start from the date of the doctor’s note provided to us.

You cannot freeze your membership if you have any outstanding fees that are overdue.

Prepaid Classes

We offer the following prepaid class passes: 

10x PRACTICE TIME $89 Valid 3 months

We will not refund you if the prepaid pass expires before it is used.

Cancellation Policy 

The cooling off period is 48 hours. If you contact us to cancel at info@thebrassroom.com.au within 48 hours of signing up we will cancel your membership minus your first payment which is not refundable. If you have paid up front for your enrolment, we will provide a refund but will charge a $25 cancellation fee.

If you wish to cancel your membership within the minimum term, you are still liable for and must pay the balance owing of the minimum term. If you have an injury or illness which prevents you from completing your minimum term, you can suspend your membership for up to 8 weeks provided a medical certificate is supplied (see ‘Membership Suspension’).

In order to cancel your membership after your 8 week minimum term, you must personally do this using the Momence webpage on your desktop or mobile. Your membership will continue to roll over weekly until you personally cancel your membership.

If you have paid up front for your enrolment or class, there are no refunds if you can no longer attend. If you have an injury or illness and provide a doctor or physiotherapist’s note, we can provide a credit voucher to the value of the missed classes from the date of the doctor’s note provided.

If you do not comply with these Terms and Conditions, your Membership Agreement, our Policies and or the Direct Debit Service Agreement, we may cancel your membership and you cannot make a claim against us. 

Due to a government enforced lockdown all membership fees will be suspended. All prepaid classes will be credited to your account.

Managing your Class Bookings

It is your responsibility to book your classes in advance via The Brass Room app, website. You can manage your schedule by the following methods: 

• MOBILE by logging into the The Brass Room App 

• ONLINE by logging into your account via www.thebrassroom.com.au

Class Terms

Our class terms are designed to be attended for the full 8 (or 4) weeks. The skills are progressive, and dance routines continue from week to week. You can only book into course levels that you have successfully completed the pre-requisite for. When booking your term classes please select the same day/time each week. Bookings are essential. 

Casual Classes

Our casual classes are designed to complement our course syllabus and can be attended on a drop in basis. Bookings are essential. 

You must be at least 16 years of age to become a student. The Brass Room studios are open to all genders. 

If we do not enforce our terms and conditions under any agreement with you at any time, we have not waived those rights. We have 7 days after you have signed your Membership Agreement to correct and recover any miscalculation in your Membership Agreement 

Private Lessons

Private Lessons is a speciality session booked by appointment throughout the studio term. 

The payment for the Private Lesson must be made in full upon booking.

A minimum of 24hrs notice is required to cancel a Private Lesson. The payment is not refundable but may be transferred to another time at the discretion of the studio, and subject to availability. Cancellations must be made by phone or email to the instructor or studio.

Workshops

Workshops are speciality classes held regularly throughout studio terms. 

Payment for workshops must be made in full upon booking the workshop. 


A minimum of 24 hours’ notice is required to cancel a workshop. The workshop fee is not refundable but can be transferred to another workshop subject to availability and if cancelled 24 hours prior to the workshop. If you cancel within 24 hours of the workshop, your fee is not refundable or transferable to another service but can be transferred to another student. 

Guest Instructor Workshops A minimum 7 days’ notice is required to cancel a workshop by a guest instructor (a guest instructor is an instructor that is not a Brass Room instructor). The workshop fee is not refundable but can be transferred to another service subject to availability and if cancelled 7 days prior to the workshop. If you cancel within 7 days of the workshop, your fee is not refundable or transferable to another service but can be transferred to another student. 

Pole Parties

Pole Parties are available for larger groups usually for recreational purposes. 

Tentative bookings can be made initially, with the booking deposit of $400 for 10 people ($40 per head) to be paid within 2 weeks of the tentative booking. We can request this to be sooner depending on the season and how far away the party is to the booking. Any remaining balance is payable on the day prior to the party commencing. 

A minimum of 4 weeks’ notice is required to cancel a party. The party deposit will be refunded less a $200 cancellation fee, or you can transfer your function to another date subject to availability. If you do not provide the required notice, there is no refund and no transfer of the deposit. 

Health

It is your responsibility to notify us in the event of an injury or medical condition prior to class. If we are of the view that you are not fit to participate in a class, we have the right to refuse your participation and our decision is final. Suspension and cancellation of your membership and catch up classes in this situation will be governed by these Terms and Conditions. You must not attend the studio if you have an infection, contagious illness or physical ailment such as open cut or sore, or where there is any other risk to other students, guests or yourself. You agree to pay the cost of and authorise us to take all steps we consider reasonably necessary to protect your welfare in the event of personal injury, including the administration of any emergency first aid treatment and ambulance transportation. 

Class Transfers

You cannot transfer your class pass, membership, private tuition, or function to another student. 

Class Cancellations

We reserve the right to cancel any class, workshop or private tuition with minimum 2 hours’ notice. This could be due to illness, not reaching minimum numbers required to run it, or another reason out of our control. We will credit or refund payments for classes which we have decided to cancel.

Warm ups

Please note classes start on time - sorry, no late entry! In the interest of your safety students will not be permitted to attend class once the warmup has commenced. We appreciate your understanding and cooperation. However, we will offer a catch up class that can be taken in the same term, subject to availability. 

Conduct

The Brass Room is a place where we strive to empower all students to feel good about themselves and build confidence. We are committed to creating a positive and encouraging community for all. All students must be respectful and supportive of their fellow Students and Instructors. We do not tolerate bullying or disrespecting of other students or instructors. Such behavior may result in removal from the studio and being banned from taking classes at The Brass Room.

Please respect your fellow students and instructor by not using your phone during classes and keeping it silenced. If you must take or make a phone call please do so only in emergency situations and without being disruptive to the class – by letting your instructor know beforehand. 

Please do not wear jewellery (in particular rings) or anything with rivets, hooks, zippers or studs that may scratch or tear any equipment. You may be responsible for any damages to apparatuses due to your negligence of this policy.

Class Rules 

Always follow the instructor’s cues and adhere to the lesson structure. Our syllabus is progressive in nature and is designed to meet you at your current level. If you do not follow the lesson structure it is not only disruptive to the class but it presents a safety concern. 

We ask that you follow the directions of the instructor and that any misconduct or refusal to do so may result in the cancellation of your membership and immediate removal from the class. Any such non-compliance may result in injury as a failure to comply.

Students may not instruct or spot each other, please leave all instruction to your instructor. 

Please proceed at your own pace and do not exceed your current capabilities. Your instructor is there to guide you but you are always responsible for knowing your own limitations. 

Practice Time 

Please do not teach or spot, or ask another student to teach you in Practice Time. Safely practice moves taught to you in class and do not attempt any tricks from higher levels that I have not been taught in class. A mat is provided as a safety precaution when practicing new tricks. By attending a practice time you agree to follow the rules and that any misconduct or refusal to follow any rules can result in the cancellation of your membership and your immediate removal from the practice session. That any such non-compliance may result in injury, as a result of my failure to comply.

Studio Hire

The Brass Room must be notified of all persons attending during the studio hire. There is a 4 people maximum, an additional $20 per person for any extras. You are not to attempt any tricks beyond your level that you have not been taught in class. You are not to teach or be taught during these sessions. All students are responsible for their own safety during their studio hire. Mats are supplied. If attending the studio alone, you must notify The Brass Room after your session so we know you are safe. The studio and its equipment must be treated with care and must be packed up after the hire. Any damage will be charged to the hiring student. Turn off all lights, heaters, fans and stereo and close all windows when leaving. Safe key box code must not be given out, the box must remain locked on the door at all times. Failure to adhere to these conditions may result in a ban from studio hire. 

Photography

Participants involved in any activities offered by The Brass Room may be photographed or videotaped during class. Please inform your instructor if you do not wish to be filmed. The undersigned hereby consents to use of these photographs and/or videos without compensation, on The Brass Room social media or in any editorial, promotional or advertising material produced and/or published by The Brass Room.

Personal Property

You are responsible for and cannot hold us liable for any damage, loss or theft of any personal property that you may incur while on the premises of our studios. 

It is your responsibility to inform us if your contact or banking details change. We will send all correspondence and notices to the details you have provided us. 

These Terms and Conditions, our Policies and your Membership Agreement forms the entire contract you have with us. Any representations made to you by a studio employee do not form part of your contract with us unless the representations are made in writing with the approval and authority of the studio manager.
